1- DEFINITIONS

Terms of Use: Refers to these Terms of Use. Customer(s): Users who have purchased or are in the process of purchasing one or more products sold on the Site. Account: A personal web interface that any Customer or User may create on the Site. Site: The website www.athana.fr, as well as all its domains and subdomains. Company: S.A.S. ATHANA, operator of the ATHANA brand. User(s): Any natural or legal person accessing the Site, whether as a general visitor or as a Customer.

2- SCOPE

The website www.athana.shop is dedicated to the sale of a cooling device designed to relieve hot flashes. It is accessible free of charge to anyone with Internet access. The Terms of Use apply to all Users, whether or not they are Customers. They are available at any time on the Website.

The Company may modify the Terms of Use without prior notice. The applicable version is the one in effect at the time of your visit. We recommend that you save the version you downloaded during your visit.

3. PURPOSE

These Terms of Use govern the relationship between ATHANA and the Site’s Users. They set forth the rules for using the Site’s features and supplement the Privacy Policy (PP) and the Terms and Conditions of Sale (TCS). By browsing the Site, you fully and unconditionally accept these Terms of Use.

4- NAVIGATING THE SITE

The Site is accessible without the need to create an Account. ATHANA provides descriptive information about its products. This information is provided for informational purposes only and does not constitute recommendations.

5- ACCOUNT: 

  • Account creation:

To access all features, users are asked to create an account using their email address and a secure password. They must provide their first and last names, date of birth, address, and phone number. The password is personal and confidential.

  • Services associated with the Account:

The Account allows you to manage orders, purchase history, and payment methods. It is available 24/7, except during maintenance.

  • Account Suspension: 

The Company may temporarily suspend an Account if: the Terms of Service are violated, the information provided is false, or at the User’s request in the event of suspected fraudulent activity. Supporting documentation may be required for reactivation.

  • Account Deletion:

The User may request the deletion of their Account at any time by email. This action is irreversible. The Company may also delete an Account in the event of a serious breach of the Terms of Service.

6. USER RESPONSIBILITY

The User agrees to use the Site in accordance with its terms. The User must not interfere with other Users’ use of the Site. In the event of a breach, the Company reserves the right to suspend or terminate the Account.

7. COMPANY LIABILITY

ATHANA shall not be held liable for any technical malfunctions or misuse of the Site by the User. Access to the Services is free of charge and is at the User’s own risk. For Customers, liability regarding sales is specified in the Terms and Conditions.

  • Amicable resolution:

In the event of a dispute, the User is asked to submit a complaint to ATHANA. An attempt at amicable resolution is required before any legal action is taken. A mediator may be contacted via https://webgate.ec.europa.eu/odr.

  • Competent court:

For businesses: jurisdiction of the courts of the Lille Court of Appeals. For consumers: jurisdiction of the ordinary courts.
